Q. What's an H-1B Visa?
A. The H-1B visa allows professional workers to work in professional positions in the U.S. for up to 6 years.
Q. How do I know if I qualify for the H-1B Visa?
A. You must have at least a U.S. Bachelor Degree or its equivalent and/or experience in your field. In addition, the
job must require a U.S. Bachelor Degree or its equivalent. And the sponsoring company must be a legitimate U.S. company.
Q. Who can apply for an H-1B Visa?
A. The U.S. Company files an H-1B Visa Petition on the alien's behalf.
Q. Can I come to the U.S. on a B-1/B-2 Visa and transfer to the H-1B Visa without leaving the country?
A. In most cases, yes.
Q. How do I find a U.S. company that will sponsor me for an H-1B Visa?
A. Your job search will be essentially the same, just a little more difficult than if you were a U.S. Citizen or
Green Card holder. You will find some companies that will know the process of petitioning for an H-1B Visa and some
companies that have no idea of where to begin.
You should find an immigration attorney that will file on the companies behalf when you get a job offer.
If the company wants to hire you, but seems hesitant because they lack the knowledge or experience in
petitioning for an H-1B Visa, let them know you have an immigration attorney who will handle everything.
